Terms and conditions

Clear, fair terms so we both know what to expect. They apply to every project and service I provide, alongside the details in your quote.

1. About these terms

These terms apply to all services provided by Medium XL ("I", "me", "the designer") to you ("the client"), including web design, branding, print and signage design, photo and video editing, hosting and maintenance. Your quote sets out the work, price and timeline for your project. If the quote and these terms differ, the quote applies.

By paying a deposit or invoice, you acknowledge that you have read, understood and agree to these terms.

2. Quotes and deposits

Quotes are valid for 30 days from the date they're issued. Work begins once the deposit set out in your quote has been paid. Anything not listed in the quote is extra work, and I'll confirm the cost with you before starting it.

3. Payment

Payment is due within 30 days of the invoice date. A late fee of 1.5% per month will be applied to unpaid balances. If an invoice is overdue, I may pause work, and final files, website launch or handover may be held until the balance is paid.

4. Your responsibilities

To keep your project on track, you agree to supply content (such as text, images and logins) and feedback in reasonable time. Timelines are estimates and depend on this; delays on your side may move the finish date. You confirm that you own, or have permission to use, everything you supply, and that it doesn't break any law or anyone else's rights.

5. Revisions and edits

Your quote includes the number of revision rounds stated in it. Additional revisions, or changes after a design has been approved, will be billed per hour at my current rate, which I'll confirm before starting.

6. Ownership and copyright

Once your project is paid in full, you own the final design files. I keep the right to display the work in my portfolio and marketing materials. Unused concepts and working files stay with me unless we agree otherwise.

Third-party items, such as fonts, stock photos, plugins and themes, remain owned by their creators and are used under their own licences. Where a licence is needed in your name, its cost is included in your quote or charged separately.

7. Third-party services and costs

Domain names, paid plugins, stock images, printing and similar costs are paid by you, unless your quote says they're included. I'm not responsible for outages, changes or price rises by third-party platforms such as WordPress, Shopify, domain registrars or printers.

8. Hosting and maintenance

Hosting and maintenance are billed in advance for the period shown on your invoice and renew automatically until you ask to cancel. Hosting may be suspended if an invoice is overdue. You're free to move your website elsewhere at any time; once your account is paid up, I'll help you transfer it. While I take care to keep sites secure and backed up, I recommend you also keep your own copies of important content.

9. Cancellation

If you cancel the project, you are responsible for paying for all work completed up to the cancellation date. The deposit covers the start of the work and is non-refundable once work has begun. I may end a project if invoices remain unpaid or if communication stops for an extended period, and you'll be billed only for work completed.

10. Liability

Nothing in these terms excludes or limits your rights under the Australian Consumer Law. To the extent the law allows, I'm not liable for any indirect or consequential loss resulting from the use of the design or website, such as lost profits, lost data or business interruption, and my total liability for any claim is limited to the amount you paid for the service in question. You're responsible for checking final work, including spelling, prices and contact details, before you approve it for print or launch.

11. Confidentiality and privacy

I keep your business information, logins and files confidential and only use them for your project. Personal information is handled as described in my privacy policy.

12. Governing law

These terms and conditions will be governed by and construed in accordance with the laws of New South Wales, Australia.

13. Changes to these terms

I may update these terms from time to time. The version in place when you accept your quote applies to your project.
